Just ask James Bain, Orlando Boquete, Larry Bostic, Alan Crotzer, Cody Davis, Wilton Dedge, Luis Diaz, William Dillon, and Frank Lee Smith. They served a total of 180 years in Florida’s prisons for crimes they did not commit. Eyewitness misidentification was a contributing cause in all of their wrongful convictions. Eventually, DNA evidence came to the rescue to exonerate them. In 2010, the Florida Innocence Commission studied how unreliable eyewitness identification can be, the psychological reasons why witnesses seem so certain even when they’re wrong, and reforms other states have taken in the way law enforcement conducts photo or live lineups. Seven years later, Sen. Dennis Baxley, R-Ocala, and Rep. Gayle Harrell, R-Stuart, are sponsoring CS/SB 312 and HB 643 and hope to pass the Eyewitness Identification Reform Act that would require state, county, municipal, or other law-enforcement agencies that conduct lineups to follow specific procedures to ensure a fairer process. “As many of us who have served in the House, we remember this legislation back in 2011. It passed the Florida Senate and made all the committees in the House, but did not make it to the floor,” Baxley said, in closing on his bill in the Senate Criminal Justice Committee on February 21, where it passed unanimously, and later passed the Judiciary Committee unanimously on March 14. HB 643 unanimously passed both the House Criminal Justice Subcommittee on March 15 and the Judiciary Committee on March 27. “I’m really surprised it’s been this long before we got back around to seeing it again. It is my privilege to present it. I think it’s a good move for justice, and it will protect law-enforcement, state attorneys, and the accused from being mistakenly identified,” Baxley said. Michelle Feldman, a state policy advocate for the national Innocence Project, said, “Nationally, eyewitness misidentification is the No. 1 cause of wrongful convictions proven by DNA. This bill would not only protect the innocent, but it would protect public safety, because when the wrong person is convicted, the real perpetrator can be out harming others.” Of 349 DNA exonerations nationwide, she said, 71 percent involved eyewitness misidentification, and the real perpetrators identified in those crimes went on to be convicted of 100 additional violent crimes, including 64 rapes and 17 murders. Baxley explained that he took recommendations from the Florida Innocence Commission, created by then-Chief Justice Charles Canady, and crafted these uniform procedures: “It will require eyewitnesses to acknowledge their instructions about the lineup procedure, and they will be told that the investigation will continue, and that the individual may or may not be there. “These disclaimers and this process, many, many law-enforcement agencies already use,” he said. An individual not involved in the case, called a “blind administrator” who is not seeking a specific outcome, will administer the lineup, so the person does not either inadvertently or purposely give cues about which photo or person the witness should pick. “We advocate for best practices endorsed by the National Research Council, the U.S. Department of Justice, the International Association of Police Chiefs, and many others,” Feldman said. “That is blind administration that is required in this bill. If you can’t find a blind administrator, you can use an alternative technique, a really cheap one: The folder-shuffle method. You put the lineup photos in folders and shuffle them and hand them to the witness one at a time, so that the administrator can’t see which one is being viewed.” Two other best practices not in the bills, she said, use “fillers” that match the description of a perpetrator, so the suspect doesn’t obviously stand out. The other is witness confidence statements, where at the time an eyewitness identification is made, the administrator asks the witness about their level of certainty, in order to document at the moment of the identification how confident the witness is. “By the time the court case comes up, when there is media exposure and talking to investigators, sometimes the witness becomes a lot more confident over time,” Feldman said. “We would ask that you also include the fillers and the witness confidence statements.. . . There are really zero costs associated with this legislation. The only cost is training.” Nineteen states have adopted the best practices advocated by the Innocence Project. Feldman said the Innocence Project has a certified eyewitness identification trainer to give statewide training at no cost. She said wrongful convictions by eye-witness misidentification have cost taxpayers in Florida more than $6 million in civil lawsuits.last_img read more

Make sure that others think so as well.10 Tips to a Better ResumeFocus on truths, not tricks. Finding a job is about finding a match. If your resume doesn’t truly represent who you are, you’re only hurting yourself. A well-written resume helps build confidence and credibility in a candidate, but that only holds true when it is a true depiction of who we are. “Fluff” and exaggeration have a tendency to come to light at some point during the search process, and once credibility is lost, so is the opportunity.Use a resume format that grabs attention, and holds attention. It’s important that you choose a format that is visually appealing, but it also must be easy to read, and easy to follow. The reader must be able to segregate jobs, segregate skills, and segregate other valuable information about the candidate. The resume should be well organized, and allow the reader to take the different pieces that make up the candidate and put them together in a systematic way that paints a clear picture. Allow the decision maker to structure their thoughts in a way that helps them draw a conclusion – and the right conclusion.In the most basic of terms, the most important thing on your resume is your NAME. Your name should stand out, and be the first thing that people see when they look at your resume. Isn’t that the point to begin with? We want decision makers to see and remember our name, and who we are. That’s not to imply that it should be in big purple letters across the top of the entire document, but it should stand out. Use a font (typically 18-24) that is larger than the rest of the text.Use fonts for the text that offer a professional appearance and are easy to read. A resume shouldn’t look like a wedding invitation or a graduation announcement. Scripted or complex fonts should not be used for your resume.Don’t simply post a list of job descriptions. It’s not just the position that you’ve held that’s important, but what you’ve accomplished in that position that will set you apart. Represent your talents, skills and abilities! Did you make a difference? Did you build partnerships? Were you commended for your performance? Was there anything that showcased your abilities? Not if you don’t say so! Remember, if you don’t say so, it didn’t happen as far as anyone else will ever know.Choose information that best represents the role that you filled, and what you were able to do with it. What’s most important about a particular role? What’s important to say about what you did in a particular role? We typically won’t have the space to say all that we want to say, so we want to use our available space to send the best possible message.Use descriptive words that show action, responsibility, accountability, leadership, cooperation, and potential. Manage, develop, implement, supervise, lead, direct, train…Find power words that accurately describe your responsibilities.Education reflects a professional investment. Accurately and appropriately describe your education. For example, if you’ve graduated from college, make sure that you say so. “2005 graduate, University of (Anywhere USA); Bachelor of Science in Business Administration.” One of the most common places that individuals will embellish or misrepresent their background involves their education. If you’ve spent the time, effort and financial resources necessary to receive a degree, you’ve earned the right to display your commitment. Make sure that you do so.The proof is in the details. Proofread your resume for any potential errors in spelling or grammar. Ensure that dates are correct. Make sure to display complete contact information to include full address, phone number(s), and email address if available. As simple as it sounds, many will miss basic but crucial details that can cost opportunities.Keep your resume current. The best opportunities often come when we’re not looking for them. Waiting until a need or opportunity presents itself may lead to delays, mistakes or exclusions that can prove costly. Technology: Kundra Resignation Blow to Government

first_imgOne bright spot in the Obama administration has been the handling of IT in the Federal Government.   Federal IT is in the midst of a turnaround, and much of the success has been due to Obama’s creation the new role of federal chief information officer and the appointment of Vivek Kundra to that position.   Indian-born Kundra held the position of Federal CIO for two and one-half years.  Kundra is leaving in August to become a joint fellow at Harvard University’s John F. Kennedy School of Government and the Berkman Center for Internet and Society.While all is not rosy with the current state of IT in the Federal government, Kundra was a strong an influential leader, and set a new direction.  As somewhat of an anomaly to how government typically works, the changes Kundra made within federal IT seemed to be smart and well thought.Kundra took the Federal CIO job at a time when operational costs of the aging government IT infrastructure were increasing rapidly, and failed projects were common.  He attempted to streamline IT infrastructure and identified areas for cost savings.  He initiated a strategy to consolidate government IT data centers and developed a strategy for moving forward with the idea of cloud-based computing.  And while many of those problems still exist, Kundra has steered the efforts in a good direction.Kundra acknowledged as recently as April of this year that federal IT had many problems still to overcome.  “The president is absolutely right. When we came into office, federal IT was undeniably broken.  These problems weren’t created overnight, and they won’t be solved overnight.”John Wonderlich of the Sunlight Foundation commented that “Vivek built the and the IT Dashboard as tools to aggressively pursue transparency that affects how the government works.”Kundra commented on his resignation by saying “The work that I dedicated myself to while serving as the federal CIO – in cutting waste, strengthening cybersecurity and building an open and transparent government through technology will also drive my research interests on both the national and international levels.”One of the reasons for Kundra’s exit may be the environment of budget cutting.  Congress has reduced the funding for the e-government initiative from $38 million to just $8 million.  Those dollars exist to fund projects like, and  Budget cuts caused Kundra to have to eliminate the Fedspace social network program and severely cut back on other project funding.What’s next?  We’ll have to wait and see.last_img read more

North Carolina Budget Bill Makes Major Tax Changes, Updates Conformity

The legislation updates the IRC conformity date for computing corporate and personal income tax liability and includes many other income tax changes.IRC ConformityThe legislation updates the IRC conformity date from January 1, 2017 to February 9, 2018.Sales Factor Sourcing RulesThe legislation requires that a corporate income taxpayer’s sales factor include receipts from certain incidental services. The requirement applies to incidental services sold as part of, or in connection with, the sale of tangible personal property in North Carolina.Under current law, a taxpayer’s sales factor must include receipts from services if the taxpayer performs the income producing activities in North Carolina. The legislation incorporates existing Department of Revenue sourcing rules for services. An “income-producing activity” means an activity performed for the ultimate purpose of generating the sale of the service. It applies to activities directly performed by the taxpayer or its agents. If the taxpayer performed income-producing activities in and outside North Carolina, the taxpayer must source the receipts based on a ratio that compares:the income-producing activities performed in the state; andthe total income-producing activities performed everywhere.Repatriation Transition Tax AdjustmentsThe Tax Cuts and Jobs Act of 2017 (TCJA) enacted the IRC Sec. 965 repatriation transition tax. The new Code section requires taxpayers with untaxed foreign earnings and profits to pay a tax as if those earnings and profits had been repatriated to the U.S. IRC Sec. 965(c) allows a deduction for a portion of the repatriated earnings that reduces the overall tax rate.The legislation allows taxpayers computing North Carolina corporate income tax liability to subtract IRC Sec. 965 income. However, taxpayers must addback the IRC Sec. 965(c) deduction.FDII and GILTI AdjustmentsThe TCJA added Code sections concerning intangible income earn by corporations outside the United States.IRC Sec. 951A requires U.S. shareholders of any controlled foreign corporations (CFC) to include its global intangible low-taxed income (GILTI) in gross income for the tax year. This provision operates in a manner similar to Subpart F.IRC Sec. 250 provides domestic corporations with reduced rates of U.S. tax on foreign-derived intangible income (FDII) and GILTI. It also allows a deduction for a portion of the domestic corporations FDII and GILTI.The legislation allows taxpayers computing North Carolina corporate income tax liability to subtract GILTI. However, taxpayers must addback the IRC Sec. 250 deduction.Deferred Gain on Opportunity Zone PropertyThe TCJA created IRC Sec. 1400Z-2(b) which allows taxpayers to elect to exclude gain on the sale or exchange of property from income if the taxpayer reinvests the gain in a qualified state opportunity zone. The taxpayer must reinvest the gain within 180 days of the sale or exchange. The election allows the taxpayer to defer gain until the earlier of:the tax year in which the investment is sold or exchanged; orDecember 31, 2026.If the taxpayer recognizes deferred gain on December 31, 2026, before the fund investment is sold, the recognized gain increases the basis in the fund.The legislation requires an addition adjustment in determining North Carolina income tax liability for the deferred gain. The adjustment does not result in a difference in basis of the assets for North Carolina and federal income tax purposes.Individual income taxpayers must also add the amount of gain that the taxpayer would include in federal adjusted gross income but for the step up in basis.The legislation allows taxpayers to subtract gain when the taxpayer recognizes it for federal income tax purposes. This adjustment would prevent double taxation of income since the taxpayer already reported the deferred gain as income in North Carolina.Domestic Production Activities DeductionThe legislation repeals the income tax addbacks for the domestic production activities deduction (DPAD) under IRC Sec. 199. The TJCA repealed the federal DPAD for tax years beginning after 2017.Addback for Renewable Energy Property DonationsThe legislation eliminates the corporate income tax addback for charitable contributions of property when the taxpayer also claims the North Carolina renewable energy property donation credit. The addback applied to charitable contributions made to:nonprofit organizations; andNorth Carolina state and local government agencies.Franchise Tax Depreciation AdjustmentCorporations computing the net worth basis of the North Carolina franchise tax can claim a deduction for accumulated depreciation, depletion, and amortization. A corporation must apply the method it used for its federal tax return when determining the deduction. In addition, the corporation must also determine the value of the underlying assets applying the same method it used for federal income tax purposes.Tax Exemption for Foreign Captive Insurance CompaniesThe legislation provides an exemption from North Carolina insurance gross premiums tax to foreign captive insurance companies formed and licensed under the laws of another state. North Carolina captive insurance companies must file a return and pay tax on premiums for business done during the year.Personal Income Tax Filing ThresholdsThe legislation ties North Carolina personal income tax filing thresholds to the state’s standard deduction instead of federal income tax filing thresholds. Taxpayers must file a North Carolina income tax return if their federal gross income exceeds:$17,500 for taxpayers with a filing status of married filing jointly or qualifying widow(er);$14,000 for taxpayers with a filing status of head of household; or$8,750 for taxpayers with a filing status of single or married filing separately.Nonqualified Withdrawals From IRC Sec. 529 Education Savings PlansThe legislation modifies the personal income tax addback for nonqualified withdrawals from IRC Sec. 529 education savings plans. Effective for tax years after 2017, North Carolina requires the addback to federal adjusted gross income if the taxpayer does not use the amount withdrawn to pay for education expenses permitted under IRC Sec. 529.The addback provision previously referred to “qualified higher education expenses”. The TJCA amended IRC Sec. 529 to allow the plans to distribute no more than $10,000 in tuition expenses during the tax year for designated beneficiaries enrolled at a public, private, or religious elementary or secondary school.The North Carolina addback does not apply if the withdrawal was:rolled over to a savings accounts for individuals with disabilities and their families, called an ABLE account; ornot subject to the additional tax imposed by IRC Sec. 529(c)(6).Automatic Filing ExtensionsEffective for tax years beginning on or after January 1, 2019, North Carolina grants an automatic return filing extension to all taxpayers, including partnerships, if the taxpayer received an automatic extension to file a federal income tax return.Federal Determinations and Amended ReturnsThe legislation changes the requirements for reporting federal audit adjustments to the Department of Revenue. A taxpayer must file a North Carolina income tax return if:the IRS or other competent authority changes or corrects the taxpayer’s federal taxable income or federal adjusted gross income; andthe federal change or correction affects the taxpayer’s North Carolina income tax liability.The return must reflect each federal change or correction. The taxpayer must file the return within 6 months after receiving notice of each federal change or correction.The legislation adds a requirement that taxpayers file an amended North Carolina return if they filed an amended federal return. If the amended federal return would increase the taxpayer’s North Carolina income tax liability, then the taxpayer must file an amended state return within 6 months. If the amended federal return would decrease the taxpayer’s North Carolina income tax liability, then the taxpayer can file the amended state return within the limitations period for seeking a refund.The federal determination and amended return requirements also apply to:fiduciaries;employers, pension payers, and other payers required to withhold North Carolina income taxes.Penalties apply to taxpayers who fail to follow the federal determination and amended return requirements. first_img17 Year-old Adam O Keefe can appreciate the skills and longevity of many of the competitors at the 2007 National Touch League (NTL) Senior tournament, a lot better than most.Adam is a Level 4 referee whose father Phil is a member of the 2007 Mets Men’s 50s Team competing at the NTL.Adam and fellow whistleblower 16 year-old Tom Ralph, stand out with their fresh faces, wide eyes, and youthful enthusiasm – a complete contrast to the environment that they are operating in over the next four days.The air reeks of maturity, life experience, and a familiarity and respect forged from many years of battle on touch fields around the nation. There are firm friendships and fierce rivalries everywhere you look that provide an insight into the proud history of our game as well as the passion that burns brightly still in the hearts and minds of the veterans of our sport.The legs might be a bit slower, the recoveries might take a bit longer, the sub box rules might have a few of our golden oldies searching for an instruction manual (like the rest of us!) – but the brain, guile, skill level, and the determination and will to win is firmly in check.These players are masters of their game, and after a lifetime of competing they have earned the title, a fact not lost on young Adam O‘Keefe.“It’s great to be here. To be refereeing my first Adult NTL is a big deal. I reckon seeing my Dad still running around is fantastic and to see all these other people enjoying running around and achieving things makes me see how much you can get out of yourself no matter how old or young you are. It’s inspirational. I’m having a ball.” Adam said.It’s ironic that the Year 12 Loyola Catholic School student talks about being inspired by others.The quietly spoken, unassuming, and ever smiling young man can lay claim to some pretty inspiring qualities himself.When Adam was seven he was diagnosed with leukemia.The Penrith youngster waged a courageous three-year fight with the insidious condition and after several health scares and a difficult battle to regain full health, used refereeing to springboard himself back into normal life.“Dad played at Penrith and it was a way of getting fit and being involved so I started refereeing and found that it was a lot of fun. Guys like Steve Ryan (Level 6) and Tony Doyle (Level 4) were really encouraging and have helped me out so much. I’d love to be a Level 6 someday and get to referee at International level. That would be the ultimate.” Adam enthused.Adam referees twice a week in the Adult competitions in Penrith and in recent years has attended the New South Wales Junior and Open State Cups, the 18 Years National Touch League, and the Regional championships, and admits refereeing is his passion.“I guess after being so sick, you do learn to appreciate every opportunity you get. I appreciate that I can run around – that I’m fit and healthy – that I’ll now be able to live to be as old as my Dad and participate in Touch. I really look up to top referees like Dave Baggio and Luke Mc Kenzie who make it look easy and I hope with hard work and by getting more experience I can get there too.” Adam said.Adam plays cricket and baseball as well and is a very good student who is eyeing a career in physiotherapy down the track.For now though, his goals are simple.“I just want to go for it everyday. Live each day to its full and get everything out of myself, I’d love to be running around like the guys who are participating here when I’m their age.
